TERMS AND CONDITIONS OF SERVICE

1) Introduction

These terms of use are stipulated between the user of the site (hereinafter referred to as the “User”) and Ego secret (hereinafter also referred to as “(company name)” or “Seller”). The website “ https://www.egosecret.com/ " is accessible from the URL https://www.egosecret.com/ and allows Users to benefit from the functions described in the following article 2.

For the purposes of this document, the term "Use" includes all operations carried out by the User from the moment of accessing the Site, including simple consultation, regardless of the access device (PC, tablet or smartphone), the type of connection (private, third-party, public or WI-FI) and the location of the connection.

Use of the Site implies the User's unreserved acceptance of these terms of use. These conditions may be subject to change by ego secret. It is understood that the applicable conditions are those in effect on the Site at the time of use.

2) Site functionality

The Site allows the User to:

• learn about the articles and services offered by ego secret
• make purchases in accordance with the methods set out in the Site's General Conditions of Sale;
• Post your opinions on items sold by ego secret
• post photos in relation to the items for sale.

The list of features is provided for illustrative purposes only and is not exhaustive. ego secret reserves the right to add or remove features, temporarily or permanently, without the User's consent.

3) Conditions of use of the site

3.1 The Site is reserved for adults who can be identified as private individuals, as well as minors under the age of eighteen with authorization from a parent or legal guardian, or legal entities represented by their legal representatives and/or managers. In any case, ego secret encourages anyone responsible for a minor under the age of eighteen to monitor the minor's use of the Site.

3.2 Access to certain services offered by the Site may be subject to the creation of an Account. To create an Account, the User may be asked to provide identifying information. The User agrees to provide accurate and complete information regarding his or her identity and refrains from impersonating others. If this commitment is not respected, Ego secret reserves the right to disable or delete the Account.

4) Sharing content on the site

4.1 To encourage interaction between Users, Ego secret offers various services that allow users to post content on the Site, particularly through the "Share Photos" and "Write a Review" services. For the purposes of these terms and conditions, "Content" is defined as any element posted by the User on the Site, such as text, comments, images, photos, or any type of file, regardless of its format or content.

4.2 The User is responsible for anything generated in his or her name or from his or her device. The User agrees to immediately report to Ego secret, through the website, any instances in which he or she has reasonable grounds to believe that his or her username or email address is, or may be, known to an unauthorized person. In any case, Ego secret declines any liability in the event of unauthorized third parties using a User's personal data.

5) Behavior on the site

The User refrains in particular from:

• from committing unlawful acts;
• from extracting or collecting personal data of users of the Site by any means;
• from extracting, recording or exploiting – for purposes other than the exclusive viewing while browsing the Site – data or content of others;
• from storing, disseminating or publishing any content that is illegal, prejudicial, abusive, discriminatory, incites hatred, contrary to good morals, or invasive of privacy or the rights of others, in particular rights relating to image, intellectual property or respect for privacy;
• from directly or indirectly carrying out propaganda of any kind or nature;
• from using the identity of others and/or publishing any personal information about others;
• from storing, disseminating or publishing any content that may directly or indirectly infringe the rights of Ego secret .

In general, the User undertakes to refrain from any behavior contrary to the values ​​of Ego secret.

6) Intellectual property

6.1 Content of the Site.
The Site Content respects intellectual property rights, particularly copyrights, designs, trademarks, domain names, patents, know-how, software, or databases. Ego secret owns all Site Content and all associated rights. Ego secret grants the User non-exclusive, revocable use of such content. This consent does not grant Users any rights, particularly the right to commercially exploit the aforementioned Content.

6.2 Content posted by users
Content posted by users (text, comments, files, images, photos, etc.) remains the property of the User, except where specific conditions previously accepted apply for specific services available on Ego secret websites. Users are free to decide whether or not to publish content on the Site, particularly through the "Upload Photos" service. Through this service, they accept that such content is in the public domain and freely accessible online. Users guarantee that they have the necessary authorizations to publish photos on the Site, in compliance with applicable law and with rights to privacy, property, intellectual property, image, etc. By posting photos on the Site, Users assume all responsibility, as publishers of the Content under the law, and grant Ego secret the right to reproduce, represent, upload, display, perform, transmit, and store the aforementioned content. Users authorize their name to be associated with the Content. By posting content, Users agree that it may automatically become accessible on the Internet, other websites, blogs, web pages, and social media pages of Ego secret. Users may at any time request that Ego secret cease publication, in accordance with the procedures set forth in Article 8 of these Terms of Use.

7) Responsibility

7.1 Ego secret's responsibility
7.1.1 Consultation and use of the Site are the sole responsibility of the User. Ego secret cannot be held liable for damages resulting from access to or use of the Site and the information contained therein. The User is informed that Ego secret may temporarily interrupt access to the Site for technical reasons related to maintenance and hereby waives any right to compensation. Ego secret will not be held liable under any circumstances for:

• any information consulted on the Site that is not published by Ego secret
• any network malfunctions that prevent the Site from functioning correctly;
• any data loss;
• any software malfunctions;
• any consequences arising from computer viruses, bugs, anomalies or malfunctions;
• any damage caused to the User's PC/tablet/smartphone.

7.1.2 Ego secret allows Users to interact with each other through the posting of reviews. As a Host, pursuant to Articles 16 and 17 of Legislative Decree 70/2003, Ego secret cannot be held liable for the activities or content stored on the Site. Ego secret's liability is limited to that set forth in Article 17(2) of Legislative Decree 70/2003, according to which Ego secret will be required to:

• to inform the judicial or administrative authority if it becomes aware of illegal activities or information;
• to provide, upon request by the competent authorities, the information in its possession that allows the identification of the recipient of its services, in order to identify and prevent illegal activities.

Ego secret is civilly liable for the content of such services only if, upon request from a judicial or administrative authority, it fails to prevent access to such content or if, after becoming aware of the unlawfulness of the content, it fails to inform the competent authority. Ego secret has the obligation and right to remove any unlawful or manifestly unlawful content without prior notice to the user, in accordance with the provisions of Article 17 of the aforementioned law. Consequently, Ego secret is not required to exercise prior control over the quality, safety, truthfulness, or legality of the Content posted by Users.

7.2 User Responsibilities
7.2.1 By using the Site, the User agrees to release Ego secret from any liability and to hold it harmless from any damages, costs and charges, direct and indirect deriving from:

• complaints from third parties regarding content deposited in their name, in particular for violation of rights on content published on the Site;
• any activity related to participation on the Site that is contrary to these general conditions;
• violation of these Terms of Use of the Site.

7.2.2 Ego secret draws Users' attention to the possibility of publishing or sharing photographs and images. Ego secret requires Users to maintain respectful behavior and adhere to Ego secret's etiquette and values. Any non-compliant Content will be systematically removed from the Site.

 

8) Personal data protection

8.1 The User can consult Ego secret's Personal Data Protection Policy through the following links: www.ego secret.com/policies/privacy-policy

 

9) Deletion of content posted by users

9.1 Ego secret reserves the right to delete any profile, content, or information published on the Site, and may prohibit use and access to the Site upon becoming aware of a User's failure to comply with the Terms of Use or for technical reasons. Any modification or deletion may be made without prior notice, notification, or communication, at Ego secret's sole discretion. Any User may inform Ego secret if Content has allegedly been published in violation of these Terms of Use. To this end, the User may send a notification to egosecret11@gmail.com . The User is required to attach all necessary details to the notification.

9.2 The User also has the option to request the deletion of content posted on the Site. To do so, they must send a request to remove the Content by email to egosecret11@gmail.com . This request must be accompanied by information that allows the content to be identified. For content posted using the "Upload Photo" service, the information required for deletion is: last name, first name, email address used when posting the Content, year of posting, and title of the content.
Any well-founded and legitimate request will be processed as quickly as possible by Ego Secret. The User acknowledges that Ego Secret cannot be held responsible for the time required to process the request or for the material impossibility of responding to it.

10) Integrity

If one or more clauses of the general conditions of use are declared null and void following the application of a law, a regulation or a final judicial or administrative decision, the other clauses will retain their force.

11) Applicable law/disputes

These general conditions of use are governed by Italian law.
